General conditions

The following booking conditions form the basis of your contract with the owner of the website soulwandering.eu (or ‘us’). Please read them carefully as they set out our respective rights and obligations. By asking us to confirm your booking, we are entitled to assume that you have had the opportunity to read and have read these booking conditions, that you agree to them and that you agree to them applying to the trip arrangements that you book with us and which we agree to make, provide or perform (as applicable) as part of our contract with you. References in these booking conditions to your ‘walk’ are references to the walk you have booked contacting us through the contact form on the website soulwandering.eu.

   Governing law

These booking conditions are governed by the law in force in Spain, any dispute concerning the contract shall be submitted to the jurisdiction of the courts of Barcelona (Spain).

   Booking and payment details

Due to the upfront commitments arranged for this tour, a non-refundable deposit of 20% of the total tour cost is required to confirm this booking. There is a second installment of 50% 60 days before your journey commences. Final installment is due 45 days prior to departure. Bookings made within 45 days of the departure date requires full payment. If you reserve your trip within 45 days of departure, full payment is required. To complete your reservation, you must sign and return the contract we will send you.

   Method of payment

Payment must be in EUR, and can be made by transfer wire. All bank fees derived from bank transfers from US dollars or any other currency to euros and / or international processing fees are the responsibility of the traveller. A 30 EUR charge will be added if the reservation needs to be refunded.

   Credit & debit surcharges

If you pay by credit card, surcharges will apply. In the case of credit cards a surcharge of between 1,5% and 3% (depending on the card used), will be added to the tour price.

   Pricing

Our prices are shown in EUR per person, and they are based on double occupancy. In the case of guests who wish to have their own room, they will be charged a Single Supplement of between 20€ and 60€ (depending on the lodging), for each specific night when a single room is available.

   Not included in holiday package price

Travel insurance, cost of travel to and from the start / return point of your trip including your international flights, cost of passport and visas, personal equipment and personal expenses while on the trip and any other expenses not specifically mentioned on the trip description and/or invoice.

   Cancellation policy

Once the due date of an installment passes, that portion of the installment becomes non-refundable. Essentially this means all installments are non-refundable once they are paid. No further payments shall be due after cancellation.

   Walks cancellations or changes by us

We reserve the right to cancel any walk at any time for any reason determined at our sole discretion, including if there are too few participants, or if the quality of the trip, or the safety of travellers is judged by us to be compromised. In such a case, refund of payments received shall constitute full and final settlement. In the event of cancellation, we are not responsible for any loss incurred on account of non-refundable or non-transferable air tickets or other unrecoverable travel costs.

   Travel insurance

It is essential that you have adequate and appropriate cover for your walk including any adventurous activities such as trekking. It is important to have adequate insurance which will cover cancellation costs from the date of booking as well as medical expenses (including evacuation and repatriation). Please read your policy details carefully and take them with you on your trip. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.

   Health

You are taken to confirm at the time of booking that you are in good health, physically capable of undertaking all aspects of the trip, and unaware of any reason why you may be unsuited to taking part or may be likely to suffer illness or injury during the trip, taking into account its challenges and purposes. If you are unable to give for this confirmation for any reason or have any medical condition or disability which may affect your trip, you must contact us before you submit your application form so that we can assist you in considering the suitability of the trip for you. If any information given in the application form questionnaire is shown to be materially incorrect or incomplete, we reserve the right to cancel your booking or terminate your participation in the walk, depending on when we become aware of the true position. In this situation, cancellation charges will apply and we will not be responsible for any costs or expenses incurred as a result.

   Risks

SoulWandering walks are intentionally designed to take clients to places where facilities, infrastructure, safety and other standards may not be sophisticated and may be different from those in a traveller’s home country. Walks involve physical activity that can be demanding, depending on the condition of the traveller, and the risk of serious personal injury, including permanent disability and death from accident, illness or the actions or negligence of other persons. There are other risks associated with the walks, such as theft or loss of or damage to property. Some of the services provided in connection with the trip, including lodging, transportation, food service, and local tours and activities, are obtained from independent suppliers over whom the owner of the website soulwandering.eu has no control.

   Release of liability

By sending a deposit toward your walk booking and returning the signed contract, you certify that you do not have any physical condition or disability that would create a hazard for you or other travellers. The client agrees that to the fullest extent permitted by law, the owner of the website soulwandering.eu shall not be liable for any claims for emotional distress, mental anguish, consequential damages, lost profit, loss of enjoyment, lost revenues, replacement costs, compensatory damages and/or punitive damages, whether or not foreseeable and/or arising from any negligent act or omission on the part of any person. All vendors, transportation, accommodation, restaurants, tour services etc, are independent and are purchased by the owner of the website soulwandering.eu for the walk package, who acts only in the capacity of an agent upon the legal conditions that, while exercising every possible precaution, he is not responsible for injury, sickness, damage, loss, additional expenses, accidental delay, or other irregularities which may be caused either through willful or negligent acts or omissions made by the companies or individuals providing or engaged in transportation, accommodation or other services related to the accomplishment of the event, or through illness, disease or force majeure such as natural disasters, social upheavals or other causes. The owner of the website soulwandering.eu’s liability for any claim, breach or damage by reason of any act or omission shall be limited to repayment of sums paid by the client only. It is the client’s responsibility to check and fulfill the passport, visa, health, and immigration requirements applicable. The owner of the website does not accept any responsibility if the client cannot travel, or incur any other loss because the client has not complied with any passport, visa, immigration requirements, or health formalities.
